Welcome to Upscale Home HQ. This website is operated by Trevor C. Select LLC (d/b/a Upscale Home HQ), a New York limited liability company ("we," "us," "our"). By visiting our site or purchasing from us, you agree to these Terms of Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase from this store.

2. Products, Pricing & Errors

We are an authorized dealer for every brand we sell. Product specifications are provided by the manufacturers; confirm critical dimensions and utility requirements before ordering (our Free Spec Service exists for exactly this). Prices are in U.S. dollars and subject to change without notice. We reserve the right to correct pricing or listing errors and to cancel and refund any order affected by such an error.

3. Orders

Your order is an offer to purchase. We may accept or decline any order, including where fraud is suspected, the shipping address is outside our delivery area, or a listing error occurred. Shipping and returns are governed by our Shipping Policy and Returns & Refunds Policy, which are incorporated into these Terms. Billing terms are described on our Billing Terms & Conditions page.

4. Installation & Use — Read This

The products we sell include gas-fired appliances, fire features, and hot tubs and spas requiring electrical service. You agree that:

  • All gas connections (natural gas or propane) and hardwired electrical connections must be performed by a licensed professional in accordance with the manufacturer's installation instructions and all applicable local codes and permit requirements.
  • You are responsible for verifying local code, permit, setback, and clearance requirements before purchase and installation.
  • Products must be used as intended and in accordance with the manufacturer's manuals. Improper installation, modification, or use may void the manufacturer's warranty and may create a safety hazard.
  • We are not liable for damages arising from improper installation, unpermitted work, modification, or use contrary to the manufacturer's instructions.

5. Warranties

All products are covered by their manufacturer's warranty; terms vary by brand and product line and are available on the product page or on request. As an authorized dealer, we will assist you in filing warranty claims. Except for the applicable manufacturer's warranty, and to the maximum extent permitted by law, products are provided "as is" and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.

6. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of a purchase is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including installation costs, contractor fees, or loss of use. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the fullest extent permitted.

7. Indemnification

You agree to indemnify and hold harmless Trevor C. Select LLC and its members, officers, and agents from claims arising out of your breach of these Terms or your improper installation or use of purchased products.

8. Intellectual Property

Site content, page copy, and design are the property of Trevor C. Select LLC or its licensors. Brand names and logos are the property of their respective manufacturers and are used as an authorized dealer.

9. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in New York, and you consent to their jurisdiction.

We may update these Terms at any time; the version posted at the time of your order governs that order.
